Last updated: May 15, 2025

Welcome to the Zapp Télé website. By accessing our website (https://www.zapptele.ca/) or using our services, you agree to be bound by these Terms of Use (the "Terms").

These Terms define the rules for using our platform and services, ensuring a clear, fair, and secure framework for everyone. They outline your rights and responsibilities as a user, as well as those of Zapp Télé as a technology provider.

We recommend that you read all the sections below carefully. These Terms aim to foster a trustworthy environment and prevent misuse or misunderstandings. By choosing Zapp Télé, you are choosing a company that places integrity, simplicity, and transparency at the heart of its approach.

If you do not agree to these Terms, please do not use our services.

For the purposes of these Terms, the following terms have the meanings set out below, whether used in the singular or plural:

  • "4K Device": the media device sold by Zapp Télé, preloaded with the application that provides access to the IPTV service.

  • "User" or "you": any person who accesses the Zapp Télé website, uses the services, or makes a purchase.

  • "Platform": the digital environment provided by Zapp Télé, including the website, IPTV application, and all related tools or services.

  • "Content": any channel, video, show, or media accessible via the Zapp Télé IPTV application.

  • "Subscription": time-limited access to Zapp Télé services, purchased in advance for 3, 6, or 12 months.

  • "Services": all services provided by Zapp Télé, including device sales, platform access, and customer support.

1. Company Information and Scope

Zapp Télé is a company founded in Quebec, rooted in a culture of proximity, innovation, and quality. We provide simple, effective, and user-friendly technological solutions for home entertainment. Our service includes the sale of devices (such as the 4K Device) and access to an exclusive IPTV platform.

Zapp Télé operates in full compliance with the laws of the province of Quebec and applicable federal laws in Canada. These Terms apply to anyone visiting our website or using any of our services or products. By choosing Zapp Télé, you are choosing a customer-focused company committed to offering reliable, transparent service in line with applicable regulations.

2. Eligibility and Adult Content

Our services are intended exclusively for individuals aged 18 and older. By accessing our platform, you confirm that you are of legal age in your jurisdiction. Some available content may include explicit material intended for a mature audience.

Zapp Télé aims to provide a safe, adult-oriented entertainment environment in compliance with legal and cultural standards. It is your responsibility to ensure that accessing such content is legal in your location and appropriate for your circumstances.

3. Service Description

Zapp Télé offers a turnkey entertainment solution combining technology and accessibility. Our service is based on a proprietary IPTV app pre-installed on a device (typically the 4K Device), providing access to a wide range of live TV channels and on-demand content from various sources.

Zapp Télé is solely the technology provider enabling this access. We are not the hosts, producers, or owners of the content displayed on the platform. The streams are provided through third-party sources and are subject to change without notice.

4. User Responsibilities

As a user, you agree to use our services in a responsible, lawful, and ethical manner. To ensure fair and safe use for all, you agree not to:

  • Reproduce, resell, or commercially distribute access to the service.

  • Bypass or disable any security or access control features.

  • Use the service in jurisdictions where it is restricted or prohibited.

  • Share your login credentials with others or allow unauthorized access.

  • Modify or tamper with the device or app beyond its intended use.

Each subscription is linked to one device. Each additional device requires its own subscription (e.g., $240/12 months/1 device). Unauthorized simultaneous use or breaches may result in immediate suspension or termination without notice or refund.

5. Pricing, Billing, and Subscriptions

Zapp Télé offers flexible subscriptions of 3, 6, or 12 months. All subscriptions are prepaid and non-contractual. Renewals are processed directly on our website at the customer’s initiative. New months are added to the active subscription.

Once payment is received, service access is generally extended within two (2) hours. Each subscription is valid for a single device. Additional devices require separate subscriptions at the current rate.

Since the service activates immediately upon payment and gives access to digital content, no refunds will be issued unless required by law. Customers should carefully review product descriptions before purchase.

6. Warranty and Device Returns

All devices (such as the 4K Device) sold by Zapp Télé come with a limited 30-day warranty covering manufacturing defects or abnormal operation under normal use. Return requests must be authorized by our customer service in advance.

Return shipping is the customer’s responsibility unless the return is due to a verified error on our part. Devices must be returned in original packaging, with all accessories, and in good condition. We reserve the right to refuse returns for devices showing signs of misuse, intentional damage, or unauthorized modification.

7. Service Availability and Force Majeure

We strive to offer stable, high-performance service. However, some disruptions may occur due to maintenance, network outages, technical failures, or the withdrawal of third-party content. These risks are inherent to connected technologies.

Zapp Télé is not liable for loss of revenue, service interruptions, content changes, or other damages resulting from partial or complete unavailability of features or streams.

In events of force majeure (natural disasters, war, government actions, major internet disruptions, etc.), we reserve the right to suspend the service without compensation.

8. Intellectual Property

The Zapp Télé app—including its source code, UI, features, visuals, trademarks, logos, domain names, and related content—is the exclusive intellectual property of Zapp Télé and is protected under Canadian and international laws.

Unauthorized reproduction, modification, distribution, reverse engineering, or derivative use is strictly prohibited.

Content accessed via the app is provided through external streams. Zapp Télé does not claim ownership of this content and disclaims responsibility for any third-party intellectual property violations. Users are solely responsible for ensuring lawful use.

9. Limitation of Liability

We work hard to provide a smooth and reliable service, but content access may be affected by factors beyond our control (e.g., third-party stream availability, geo-restrictions, or technical failures).

Zapp Télé is not liable for any loss of revenue, service disruptions, delays, content errors, or removed features. It is your responsibility to ensure that using our service is legal in your jurisdiction.

No advice or information (oral or written) from Zapp Télé creates any warranty not expressly stated in these Terms.

10. Indemnification

By using our services, you agree to indemnify and hold harmless Zapp Télé, its employees, partners, affiliates, and suppliers from any claims, liabilities, fines, or legal expenses arising from:

  • Your violation of these Terms

  • Illegal or unauthorized use

  • Intellectual property breaches or rights violations

This includes any investigations or legal actions initiated by authorities or third parties.

11. Termination

Zapp Télé reserves the right to suspend or terminate access without notice if you:

  • Breach these Terms

  • Engage in fraudulent or abusive activity

  • Compromise the platform’s integrity or security

Termination does not cancel any obligations regarding outstanding payments, confidentiality, or indemnification.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada, without regard to conflict of law principles.

Any dispute or claim shall be brought exclusively before the courts located in Quebec, unless otherwise required by law.

13. Changes to These Terms

We may update these Terms to reflect changes in services, legal obligations, or our technology environment. Any updates will take effect upon publication on our website.
